Can You Establish South Dakota Residency Without Owning or Renting a Home?

By Jenna Puetz, owner of Your Best Address

Yes. Qualifying full time travelers do not necessarily need to own or rent a traditional house or apartment in South Dakota to use the state’s full time traveler Driver Licensing process.

South Dakota DPS currently recognizes people who live full time in an RV or camper or travel full time for work as potential full time travelers. When using a mail forwarding service, additional requirements include the Residency Affidavit, proof of a qualifying South Dakota overnight stay and documentation of the applicant’s personal mailbox address.

That does not mean a mailbox alone establishes residency or domicile for every legal, financial or voting purpose.

Who qualifies as a full time traveler for South Dakota Driver Licensing?

DPS currently says that to be eligible to apply for a South Dakota driver license, you must:

    • Have a physical residential address located in South Dakota, or
    • Live full time in an RV or camper, or
    • Travel full time for work, for example as a traveling nurse or truck driver

This is Driver Licensing eligibility only. It is not a universal definition of South Dakota domicile. For the bigger picture, see how full time RVers establish South Dakota residency.

Do you need to own property in South Dakota?

No, not for the qualifying full time traveler Driver Licensing process. DPS does not require a qualifying full time traveler to own a house in South Dakota simply to use this licensing process. Property ownership can still matter for other legal or financial questions.

Do you need to rent an apartment in South Dakota?

Not necessarily. Qualifying full time travelers may use the state’s full time traveler process instead of maintaining a traditional South Dakota residence, when they meet the current requirements. A personal mailbox is not an apartment or a residence.

What address does a full time traveler use?

Full time travelers typically use an eligible South Dakota personal mailbox (PMB) through a mail forwarding service. DPS requires one document showing your name and PMB address. DPS says this could be a receipt from the personal mailbox business or a piece of mail with your PMB address on it.

DPS also says virtual addresses or virtual postal addresses will not be accepted for this process. Read more about using a South Dakota mail forwarding address for a driver’s license.

What else do you need besides the mailbox?

The mailbox is only one piece. Current full time traveler requirements include:

    • A completed Residency Affidavit
    • A receipt from a South Dakota hotel, motel, campground or RV park showing one night of stay within the last year, with your name on it
    • Documentation showing your name and PMB address
    • The standard identity and licensing documents that apply to your transaction

What does the Residency Affidavit say about having a home in another state?

The current official form is a request for an exception to the usual proof of residency requirement, intended for South Dakota residents who travel and do not have a residence in another state. Among other statements, the applicant affirms: “I do not stay, live in, or maintain a residence in any another state.”

This statement is tied to the Driver Licensing full time traveler exception. It is not tax advice. Learn more about the South Dakota Residency Affidavit.

Can you keep a home in another state and use the full time traveler exception?

Based on the current Residency Affidavit, someone who maintains a residence in another state would not be able to make the required statement, so they would not qualify for the full time traveler exception. This applies to the Driver Licensing process only. Whether to keep or sell a home is a personal decision, and this article does not advise either way.

Does one night in South Dakota replace owning or renting a home?

The one night receipt is one documentation requirement within the current full time traveler Driver Licensing process. It is not a substitute for every concept of legal residence or domicile. Read how long you need to stay in South Dakota.

Is a PMB the same as a residential address?

No. A personal mailbox is used for receiving mail and supporting the applicable full time traveler process. A residential property address is a different type of address. Some banks, insurers, lenders or other institutions may separately ask for a physical or residential address.

Most travelers do not need one, but for clients with a legitimate need, YBA offers a separate Dakota Address option.

What about banks and financial institutions?

Driver Licensing acceptance of a PMB does not guarantee that every bank, lender, brokerage or financial institution will accept the same address for every purpose. Private institutions may have their own identity and physical address requirements.

    What about insurance?

Insurers may have their own garaging, residence, underwriting and policy address requirements. A South Dakota Driver Licensing setup does not automatically satisfy an insurer. Communicate accurately with your insurance company about where you live, travel and keep your vehicles. This article is not insurance advice.

    Does this automatically establish domicile?

No single step should be described as automatically establishing domicile for every purpose. Driver Licensing, voting, taxes, banking and insurance can use different standards. Read residency vs. domicile for full time travelers.

    What about vehicle registration?

South Dakota vehicle registration is a separate administrative process. A traditional residential property address is not universally required for every South Dakota vehicle registration transaction, but separate rules and fees may apply. What should you set up before giving up your traditional home?

    • Choose the appropriate South Dakota mail forwarding service
    • Understand the difference between a PMB and a residential property address
    • Review current Driver Licensing requirements
    • Understand what documentation you will need
    • Review your vehicle registration needs
    • Talk with insurers about address and garaging requirements
    • Review banking and financial address requirements
    • Consider legal and tax advice if you are leaving a state where you have substantial ties
    • Plan your South Dakota visit

Do not sell property solely to qualify for South Dakota residency. Make that decision based on your whole situation.

    Common misunderstandings

“I need to buy a house in South Dakota.”

Not for the qualifying full time traveler Driver Licensing process. DPS eligibility includes living full time in an RV or camper or traveling full time for work.

“I need to rent an apartment in South Dakota.”

Not necessarily. Qualifying full time travelers can use the full time traveler process when they meet its current requirements.

“A mailbox automatically makes me a South Dakota resident.”

No. The mailbox is one piece. The Residency Affidavit, a recent South Dakota stay and other documents are also required, and none of these settles every legal question.

    “One night automatically establishes domicile.”

No. The one night receipt is a single documentation requirement within the Driver Licensing process.

“My PMB will work as a residential address everywhere.”

No. A PMB is a mailing address, not a residential property address, and other institutions may ask for something different.

“My driver’s license determines my tax residency everywhere.”

No. Tax residency can depend on other states’ rules and your full situation.

“If South Dakota accepts my address, my bank and insurer must accept it too.”

No. Private institutions set their own address and identity requirements.

    The simplest answer

You do not have to buy a South Dakota house simply because you want to become a qualifying full time traveler.

South Dakota has a specific Driver Licensing process for people who live full time in an RV or camper or travel full time for work. The process can use an eligible personal mailbox together with the Residency Affidavit, a recent South Dakota stay and the other required documents.

The important part is understanding which address and residency rules apply to each part of your life rather than assuming one address solves everything.
